Supreme Court Rules Juries Must Decide on Death Penalty

The high court by a 7-2 vote overturned its 1990 decision that upheld the Arizona capital sentencing law that gives sole responsibility to the judge to make factual findings necessary to sentence a convicted murderer to death.

We're back to trials by jury now?

How could we ever call any law constitutional that puts any fact finding in the hands of anybody other than a jury? I don't understand how judges are able to overturn the decisions of juries, either. And judges have basically all the authority in sentencing criminals. So what good is our jury system? We should reform it, one way or another.

(I know that all my leftist readers will be surprised by this commentary. ;-D )
